Trusts, limitation periods, and unauthorised gains
- Abstract:
- Discusses why, historically, statutory limitations did not apply to breaches of trust, and how current cases find that the limitation period under the Limitation Act 1980 s.21 is not applicable to cases involving fraudulent breach by express trustees. Considers the limitation period for actions against fiduciaries who make unauthorised profits, and suggests why none should apply where such profits are held on constructive trust.
