The foundations of torts in commercial law

Abstract:
This book is the third in the Thomson Reuters COmmercial Law series. The first two books - Equity in Commercial Law and Unjust Enrichment in Commercial Law - focused upon the operation, respectively, of equity and unjust enrichment in modern commercial law. The raison d'etre of these books was to guide their readers through contemporary challenges arising in these areas of law. The contributors identified common patterns, themes and issues in case law from Australia, England, Canada and New Zealand. Rays of optimism shone through in each contributor's quest for rationality. Not long ago, ther was cause for similar optimism in relation to the law of torts. A structure had emerged and the common law might have been said to be working itself pure. But a cloud has been cast over that hope by recent developments. This tale is told in the first part of this introductory chapter. The contribution that form this book will then be outlined.
