Will-substitutes and the claims of family members and carers

Abstract:
For most couples and families the precise ownership of property is not a question to which they tend to give much attention, save in certain interactions with third parties, such as taking out a bank loan, or where there is a family business. Generally family members give no thought to the ownership of the tin opener because it simply does not matter. Family members will not seek to claim property rights as against each other in relation to their property, at least while the relationship is intact. This means that the normal rules governing property tend not to work well in families.
