A new generation of omissions offences?
- Abstract:
- Reflects on UK law's new generation of omissions offences. Reviews the rise in criminal law's preventive uses, and the expansion of criminal liability by diffusing omissions responsibility, including failures to report, prevent or protect. Examines the principles of corporate failure to prevent economic crime, the rise of risk-based liability, the reasons for creating additional layers of criminal responsibility, and whether these are justified.
