A legal person and the standing to challenge a directive under EU Law—Nord Stream 2 AG v European Parliament and Council of the European Union
- Abstract:
- This article considers the recent judgment of the Court of Justice in Nord Stream 2 and its implications for the EU law of locus standi under art.263 TFEU. In particular, the Court accepts, for the first time, that in limited circumstances a directive may be of individual and direct concern to a private applicant. The case is situated in the broader context of standing under art.263 TFEU and the critique of its narrow scope.
