When the infringer is a contractual licensee
- Abstract:
- Considers situations in which UK copyright infringement may be committed by a contractual licensee breaching the terms of their licence. Reviews the approach in IT Development SAS v Free Mobile SAS (C-666/18) (ECJ) involving French law, and assesses the possible outcome under UK law, highlighting the need to distinguish the copyright infringement claim from the remedies for breach of contract, and the circumstances in which both are recoverable.
