Varying long residential leases: when, why and reform
- Abstract:
- Examines the role of tribunals when exercising jurisdiction to vary long residential leases. Discusses typical management arrangements in blocks of flats, the extent to which non-consensual contract modifications can be ordered, the aims of the jurisdiction, the practical operation of the Landlord and Tenant Act 1987 Pt IV, the variations sought and how individual rights-based concerns are balanced with collectivism. Considers potential reforms.
