Publicidad, certificados y cancelación de los antecedentes penales ¿La cultura del control se consolida en España desde las nuevas leyes de 2015?

Abstract:
Este artículo presenta las novedades respecto la publicidad de las sentencias, el acceso al mercado laboral y la cancelación de los antecedentes penales. El objetivo es analizar específicamente el impacto de diversas leyes en España que desde 2015 exigen la presentación de un certificado de antecedentes penales para optar a diversos empleos, en especial el Certificado por Delitos de Naturaleza Sexual (CDNS) para actividades que se desarrollan con un contacto habitual con menores. Para ello se analizan los cambios en la legislación y su aplicación práctica. Para finalizar se reflexiona acerca de las transformaciones que estas novedades conllevan en la política criminal.

Publicity, request and expungement of criminal records. Is the culture of control increasing in Spain since the new laws in 2015?

This paper describes the developments regarding the publicity of convictions, access to the labour market and expungement of criminal records. The aim of this article is to analyse specifically the impact of the new laws that since 2015 require in Spain the presentation of a criminal record certificate to apply for an important number of positions. We focus specifically in the new ‘Sexual Criminal Record Certificate’ required for all occupations with a regular contact with children. Our research explains these new laws and analyses its practical implementation. Finally, we consider the transformations of criminal policy that these changes have entailed.
