Negligent valuations and the margin for error
- Abstract:
- Discusses Bratt v Jones (CA) on whether, for the purposes of a professional negligence claim, valuation falling outside the permitted margin was determinative as to liability unless the valuer could prove he was not negligent. Highlights the ambiguous dicta in various cases concerning the law on valuations, criticising the precondition approach in Merivale Moore Plc v Strutt & Parker (CA).
