Standing and civic virtue
- Abstract:
- Analyses the concept of public interest standing in judicial review cases. Lists the criteria that have been used by the courts to assess an applicant's public interest standing, and suggests why these claimant-based factors are controversial. Proposes a rationale for the factors that is based on the notion of civic virtue. Discusses ways in which the law of public interest standing could be improved.
