Compensation for oil pollution damage : Quantifying environmental harm

Abstract:
The article examines the prevalent definition of pollution as "damage' and highlights the increased importance of the practice of the IOPC Fund. The Patmos case is examined. The rejection of the 1984 protocols to the Civil Liability Convention by the US Congress is described and the consequences of a possible two track system (one for the US and one for the rest of the world) are analysed. The Commonwealth of Puerto Rico v The SS Zoe Colocotroni case is examined and the controversy over the method of calculating quantum of damages described. The relative merits of the Soviet Metodika system as a way to place a value on environmental resources are outlined. The article concludes by raising a number of fundamental issues that will affect environmental law in the 1990s. -Author
