Does UK really have a ‘closed’ list of works protected by copyright?

Abstract:

Evaluates claims that the UK has a closed list of copyright-protected works under the Copyright, Designs and Patents Act 1988. Discusses, with reference to case law, the approach to artistic works, the definition of "graphic work", the position of three-dimensional artistic works, works of action, and the scope for flexibility in respect of architectural works. Considers the potential for recognising new subject matter beyond current categories.
