Various claimants v Barclays Bank Plc
- Abstract:
- Comments on the ruling in Various Claimants v Barclays Bank Plc (QBD) on whether a bank which required job applicants to undergo medical examinations was vicariously liable for alleged sexual assaults committed by the doctor during the examinations. Discusses the continuing expansion of the vicarious liability doctrine by removal of many earlier constraints, the extension of its reach and the need for fundamental reforms to clarify its scope.
