Familial homicide, failure to protect and domestic violence: Who's the victim?

Abstract:
This article considers the use of the offence in s.5 of the Domestic Violence, Crime and Victims Act 2004 to prosecute so-called failure to protect cases. It raises serious concerns about the use of the offence in cases where the defendant has been the victim of domestic violence. The law should focus on seeking to protect mothers and children from violent men, rather than punishing women who are themselves the victims of violence. © SWEET and MAXWELL.
